Notice Under the Americans with Disabilities Act
In accordance with the requirements of Title II of the Americans with Disabilities Act of 1990 (“ADA”), the Miami County Juvenile Court and the Miami County Probate Court will not discriminate against qualified individuals with disabilities in their services, programs, or activities.
Employment
Miami County does not discriminate on the basis of disability in its hiring or employment practices and complies with all regulations promulgated by the U.S. Equal Employment Opportunity Commission under Title I of the ADA.
Effective Communication
The Miami County Juvenile Court and the Miami County Probate Court will, upon request, provide appropriate auxiliary aids and services leading to effective communication for qualified persons with disabilities so they can participate equally in the Courts’ services, programs, and activities, in accordance with 28 C.F.R. § 35.160.
Such aids and services may include, but are not limited to:
- Qualified sign language interpreters
- Oral interpreters
- Assistive listening devices
- Real-time transcription services
- Accessible electronic documents
- Other effective methods of making information and communications accessible to individuals with hearing, vision, or speech impairments
Modifications to Policies and Procedures
The Courts will make all reasonable modifications to policies, practices, and procedures when the modifications are necessary to avoid discrimination on the basis of disability, in accordance with 28 C.F.R. § 35.130(b)(7), unless the Courts can demonstrate that making the modifications would fundamentally alter the nature of the service, program, or activity.
Service animals are welcome in Court facilities in accordance with 28 C.F.R. § 35.136, even where pets are generally prohibited.
The ADA does not require the Courts to take any action that would fundamentally alter the nature of their programs or services or impose an undue financial or administrative burden, as defined under 28 C.F.R. § 35.164.
The Courts will not place a surcharge on a particular individual with a disability or any group of individuals with disabilities to cover the cost of providing auxiliary aids/services or reasonable modifications of policy.
Website and Digital Accessibility
The Miami County Juvenile Court and Miami County Probate Court are committed to ensuring digital accessibility for individuals with disabilities. Court websites and digital documents are maintained in substantial conformance with applicable ADA Title II requirements and recognized accessibility standards, including the Web Content Accessibility Guidelines (WCAG), to provide equal access to online information and services.
Individuals who encounter accessibility barriers on the Courts’ websites are encouraged to notify the Court Administrator so that appropriate steps may be taken to remediate the issue and provide the information in an accessible format.
Requests for Accommodation
Anyone who requires an auxiliary aid or service for effective communication, or a modification of policies or procedures to participate in a service, program, or activity of the Miami County Juvenile Court or Miami County Probate Court, should contact the Court Administrator as soon as possible but no later than forty-eight (48) hours before the scheduled event, when practicable.

ADA Grievance Procedure
This Grievance Procedure is established to meet the requirements of the ADA and 28 C.F.R. § 35.107. It may be used by anyone who wishes to file a complaint alleging discrimination on the basis of disability in the provision of services, activities, programs, or benefits by the Miami County Juvenile Court or Miami County Probate Court.
Filing a Complaint
The complaint should be in writing and contain:
- The name, address, and telephone number of the complainant
- The location, date, and description of the alleged discrimination
Alternative means of filing complaints, such as personal interviews or audio recordings, will be made available for persons with disabilities upon request. A complaint form is available from the Court Administrator.
Complaints should be submitted by the complainant or the complainant’s designee as soon as possible but no later than sixty (60) calendar days after the alleged violation to:

Review and Resolution
Within fifteen (15) calendar days after receipt of the complaint, the Court Administrator or designee will meet with the complainant to discuss the complaint and possible resolutions. Within fifteen (15) calendar days of the meeting, the Court Administrator or designee will respond in writing and, where appropriate, in a format accessible to the complainant (e.g., large print, accessible PDF, or audio format). The response will explain the Courts’ position and offer options for substantive resolution.
If the response by the Court Administrator does not satisfactorily resolve the issue, the complainant or the complainant’s designee may appeal the decision within fifteen (15) calendar days after receipt of the response to the Administrative Judge of the respective Court.
Within fifteen (15) calendar days after receipt of the appeal, the Administrative Judge will review the matter and issue a written decision in an accessible format, where appropriate. This decision shall constitute the final resolution of the complaint.
All written ADA complaints, appeals, and responses will be retained by the Courts for at least three (3) years in accordance with applicable records retention requirements.
