Adoption ‐ Adult

In accordance with R.C. 3107.02, a petition for adoption of an adult may only be filed if:

  • Adoptee is totally and permanently disabled
  • Adoptee was determined to be a mentally retarded person
  • Adoptee established a child-foster caregiver, kinship caregiver, or child-stepparent relationship
    with the petitioner(s) as a minor, and the adult consents to the adoption
  • Adoptee was, at the time of the adoptee's eighteenth birthday, in the permanent custody of or in
    a planned permanent living arrangement with a public children services agency or a private child
    placing agency, and the adult consents to the adoption
  • Adoptee is the child of the spouse of the petitioner, and the adult consents to the adoption
    A birth certificate must be filed with the adoption petition.

If the adult adoptee was born outside the state of Ohio, you will need to provide the court with
the address of the Vital Statistics Department for the adult adoptee's birth state at the time of filing the petition.
